DUI/DWI Defense

Driving Under the Influence of Alcohol and Drugs

Throughout the U.S., it is illegal to operate a motor vehicle of any kind while one's abilities are impaired or while one has a blood alcohol concentration of .08% or greater. Each state has its own particular implementation of drunk driving related laws, but the basic concept remains the same. A driver may face arrest and serious criminal penalties if he or she drives "under the influence" of alcohol and/or drugs.

Most of the time, this crime is referred to as DUI (driving under the influence). In some states, however, it may be called DWI (driving while intoxicated/impaired), OUI (operating under the influence) or OWI (operating while intoxicated). Some of the penalties frequently associated with this crime include:

  • Imprisonment
  • Probation
  • Fines and court fees
  • Driver's license suspension
  • Community service
  • Alcohol or drug rehabilitation/education
  • Increased insurance costs
  • Vehicle impoundment

Challenging DUI Charges

The attorneys that represent drivers in the face of DUI charges must be trained and knowledgeable in the particular issues that are relevant to these cases. This may include breath tests and blood tests, which are used to determine a driver's blood alcohol concentration, field sobriety tests, which are used to gauge whether a driver's abilities are impaired, and similar matters. It may also be helpful to find an attorney who can handle one's license suspension hearing, which is held by the Department of Motor Vehicles or similar government agency responsible for licensing in the state. A DUI arrest and failed or refused breath or blood test will initiate license suspension proceedings, and an attorney can assist a driver by scheduling a hearing to challenge the suspension.
